The subscriber
hereby surrender to Consultas y Servicios Colibrí SA, domiciled in San José,
Costa Rica identification number tree one cero one- two hundred thirty four
thousand six hundred sixty one this MANDATE TO SELL or MANDATE TO RENT of my
property according to the specifications that it will be described in the form
“Home Post a Property for sale” or “Manage your Property”
To the
closing of an operation with an interested one, the undersigned agree to the
forms of payments as follow: in the event of Sale of the Property: The Buyer
commits to cancel in cash or by certified check to Consultas y Servicios Colibrí
SA, five percent of the property sales price upon the signature of the contract,
the rest (95%) will be canceled to the owner in cash or certified check upon
the signature of the title transfer in the public document.
Property
Lease: The Lessee commits to cancel to Consultas y Servicios Colibrí SA in cash
or certified check one complete installment once he receives as (Deposit) and
the other as one month lease upon the signature of contract with the client
.
This
agreement has a period of 12 (twelve) months. If during this period had not
arrived to happy finish, the operation will be continued automatically by another
similar period as long as no countermand in writing exist from any of the parts.
Consultas
y Servicios Colibrí SA accept the mandate, as for the mediator intervention
she/he refers, to the legally authorized person that it considers appropriate
for this intermediation and it will perceive in the event of sale in fee concept,
publicity, representation expenses and third party fees, 5% (five) of the sale
price if the property is in the Great Metropolitan area, and with 10% (ten)
of the sale price if the property is away from the same one, for the suitable
concepts previously indicated.
In case
of Lease in fees concept, publicity, representation expenses and third party
fees, she/he will receive an installment if the property is in the great metropolitan
area and two installments if it is away from the same area.
In case
the sale was carried out without Consultas y Servicios Colibrí’s participation
the Owner or Lessor agree to made it so be known promptly and he/she will reimburse
to Consultas y Servicios Colibrí SA with 0,5% (half for a hundred) of the sale
price or half installment, for expenses fees concepts to cover publicity, representation
expenses and several expenses caused by the administration.
These
fees will become effective being deduced from the first payment or the buyer's
or tenant agreement, should be paid completely when the Owner has received the
equivalent of the double amount
To Consultas
y Servicios Colibrí SA fees there will be applied the legally effective taxes
The Owner
agrees to give to Consultas y Servicios Colibrí SA a photocopy of the Properties
legal documentation and a Certification of the Properties Registration, indicating
that the same one is free of mortgages or taxes. In case of Consultas y Servicios
Colibrí SA take charge of obtaining the studies of Registration and the suitable
Certifications the expenses will be billed.
The Owner
authorizes Consultas y Servicios Colibrí SA to accept an amount of the bill
of the operation in administration in his/her behalf in order to formalize the
agreement with the buyer. This amount will never be more than 5% (five) of the
operation or one installment and Consultas y Servicios Colibrí SA agrees to
put it immediately to subscriber's knowledge.
